Terms of Use & End User License Agreement

1. Acceptance of terms

By downloading, installing, or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of service

Odyssey Guide is a walking tour application that generates personalized walking routes, provides turn-by-turn navigation, audio narration of points of interest, and AI-powered features including nearby place discovery and object identification. The App requires an internet connection for route generation, audio playback, and AI features.

3. Accounts & eligibility

You may create an account using Sign in with Apple, Google, Microsoft, or email. You are responsible for maintaining the security of your account credentials and for all activity under your account. Guest access provides limited functionality without an account. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. We reserve the right to suspend or terminate accounts that violate these Terms.

4. License grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial use, in accordance with the Usage Rules of the Apple Media Services Terms and Conditions.

5. Acceptable use

The App is provided for personal, non-commercial use. You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App, except as permitted by law
• Interfere with or disrupt the App's servers or networks
• Use automated means to access the App or its services, or to fraudulently earn or redeem Walking Tickets or ad rewards
• Redistribute, sublicense, or resell any part of the App

6. Purchases, tickets & subscriptions

Walking Tickets (consumable)

The App uses a virtual currency called "Walking Tickets" to generate walks and audio narration. Walking Tickets may be purchased in packs through the App Store or earned by watching optional rewarded ads. Walking Tickets are a limited license to a feature of the App; they have no monetary value, are not redeemable for cash, and are non-transferable. Consumable purchases are generally non-refundable once delivered, except as required by law or as provided by Apple.

Subscriptions (auto-renewing)

The App offers auto-renewing subscriptions ("Odyssey Guide Premium") on a monthly or annual basis. A subscription grants a recurring allotment of Walking Tickets and an ad-free experience for the duration of the subscription. Current pricing, ticket allotments, and subscription length are shown in the App before you complete a purchase.

The following standard auto-renewal terms apply to all subscriptions:

• Payment is charged to your Apple ID account upon confirmation of purchase.
• Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period, at the price for your selected plan.
• You can manage or cancel your subscription, and turn off auto-renewal, at any time in your App Store account settings after purchase.
• If a free trial or introductory offer is provided, any unused portion is forfeited when you purchase a subscription, where applicable.

7. Refunds

All purchases — including Walking Ticket packs and subscriptions — are processed by Apple through the App Store. Because Apple is the merchant of record, refund requests are handled by Apple in accordance with Apple's policies, and we generally cannot grant refunds directly. To request a refund, visit reportaproblem.apple.com or use the purchase history in your Apple ID account settings. Nothing in this section limits any non-waivable statutory refund or cancellation rights you may have under applicable law.

8. Rewarded advertising

The App offers optional rewarded video ads, served by Google AdMob, that you may choose to watch to earn Walking Tickets. Rewarded ads are never required to use the App's core features, and subscribers are not shown ads. The number of rewarded ads you may watch and the tickets granted are subject to daily limits and anti-fraud verification. Your interaction with rewarded ads is also subject to Google's terms and privacy policy.

9. Content & intellectual property

Walking tour routes, narrations, and recommendations are generated using artificial intelligence and third-party data sources. AI-generated content is provided for informational and entertainment purposes. We do not guarantee the accuracy, completeness, or reliability of AI-generated content. Map data is provided by Mapbox and is subject to its terms of use. The App and its original content, features, and functionality are owned by Wandering Horizons Travel, LLC and are protected by intellectual-property laws.

10. Location services & safety

The App uses GPS location data to provide navigation guidance. Location accuracy may vary depending on your device, environment, and signal conditions. The App is not a safety device. Always be aware of your surroundings while walking. Do not use the App while crossing streets or in situations that require your full attention. We are not responsible for any injury or damage that may occur while using the App for navigation. Follow all local traffic laws and safety regulations.

11. Third-party services

The App integrates with third-party services including Mapbox, Google (including Google AdMob), Apple, Microsoft, RevenueCat, OpenAI, and ElevenLabs. Your use of these services through the App is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content provided by third-party services.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (OR THROUGH THE APP STORE FOR THE APP) IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Termination

You may delete your account at any time through the App's Profile settings. We reserve the right to suspend or terminate your access to the App at our discretion if you violate these Terms. Upon account deletion, all of your data will be permanently removed from our servers as described in our Privacy Policy.

15. Apple-required terms

This section applies because the App is licensed through the Apple App Store. You and we acknowledge that:

• These Terms are concluded between you and Wandering Horizons Travel, LLC only, and not with Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to furnish any maintenance or support services for the App. Any maintenance and support is our responsibility, not Apple's.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• We, not Apple, are responsible for addressing any claims by you or a third party relating to the App, including product-liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims under consumer-protection or similar legislation.
• We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any third-party intellectual-property infringement claim relating to the App.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

16. Governing law

These Terms are governed by the laws of the United States and, to the extent applicable, the laws of the state in which Wandering Horizons Travel, LLC maintains its principal place of business, without regard to conflict-of-laws principles. Nothing in these Terms limits any mandatory consumer-protection rights available to you in your country of residence.

17. Changes to these terms

We may update these Terms from time to time. Material changes will be reflected here with a revised "Last updated" date, and significant changes may also be surfaced in the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
